1. Scope

This Acceptable Use Policy governs the designs you create, publish, and order using ArtyPop's AI tools. It supplements our Terms of Service. By using the Service, you agree to these rules. We may update them as our tools and the law evolve.

2. How Designs Are Created

Designs are generated by artificial intelligence based on the prompts, text, and options you provide. AI output is probabilistic and can be unexpected. While we apply content filters, they are not perfect and may both miss prohibited content and occasionally block acceptable content. You are responsible for reviewing every design before you publish or purchase it.

3. Designs You May Not Create

You may not use the Service to generate, publish, or order designs that:

Infringe intellectual property: copyrighted characters, artwork, or photographs; registered trademarks, logos, or brand names; or other protected works you do not have the right to use.
Use someone's likeness without permission: the name, face, or persona of a real person (including celebrities and public figures) in a way that violates their publicity or privacy rights.
Promote hate or harassment: content that attacks or dehumanizes people based on race, ethnicity, national origin, religion, disability, gender, age, sexual orientation, or gender identity, including hate symbols.
Sexualize minors: any sexual content involving minors, or content that sexualizes people who appear to be minors. This is strictly prohibited and may be reported to authorities.
Are violent or dangerous: content that incites violence, threatens others, glorifies terrorism, or provides instructions for weapons or other serious harm.
Are illegal or facilitate illegal activity in any jurisdiction where the design is created, sold, or shipped.
Deceive or defraud: impersonation, counterfeiting, or content designed to mislead.
Contain others' private informationor otherwise violate someone's privacy.

Do not attempt to evade content filters or manipulate the AI into producing prohibited content.

4. Your Responsibility for Prompts & Designs

You are solely responsible for the prompts you submit and the designs you choose to publish or order. You represent that you have the rights necessary to use any names, text, or references you include, and that your designs comply with this policy. As set out in our Terms, you agree to indemnify ArtyPop against claims arising from content you create.

5. Ownership of Generated Art

Your rights depend on your ownership tier. The Personal tier grants a limited, non-exclusive, non-transferable license for personal use. The Creator tier, where offered, grants expanded rights including resale, subject to the terms presented when you enable it. See the Terms of Service for details.
Legal status of AI art varies. Copyright in purely AI-generated images is unsettled and may differ by jurisdiction. We do not warrant that any generated design is eligible for copyright protection or is free of third-party rights.
We retain our technology. We keep all rights in the underlying AI systems, models, and prompts infrastructure. You may not reverse engineer or extract them.
Public designs & the marketplace. If you make a design public or list it, you grant us a license to display, reproduce, and promote it in connection with operating the Service.

6. Enforcement

We may remove or disable any design, cancel any order, and suspend or terminate any account that violates this policy, with or without notice. We may also report unlawful content to the appropriate authorities. Refunds for cancelled orders are governed by our Terms of Service.

7. Reporting a Violation

To report a design that infringes your intellectual property, use our DMCA & IP Takedown process. To report other violations of this policy, email support@artypop.shop.
